On the one hand, the real and/or legal person who will be referred to as the Customer in the following articles and on the other hand, the address of Puşuli Mahallesi, Yanıkdağ Köyü, 8/2, Çayeli, Rize, which will be referred to as Mabeyn Bungalov in the following articles; These parties, which will be referred to as the Parties in the following articles; Considering that this agreement is an official offer, that it contains all the conditions for the provision of paid accommodation service, that all terms and conditions specified below are binding (definitive) for the parties, that they are available on the https://www.mabeynbungalov.com/ website and that they will not be changed by the customer, have concluded this agreement within the framework of the following:
SUBJECT OF THE AGREEMENT
1.1. According to this agreement, Mabeyn Bungalov is obliged to provide accommodation service in Mabeyn Bungalov upon the request of the Customer (hereinafter referred to as the ‘Service’).
1.2. With the signing of this agreement, the Customer; Mabeyn Bungalov will confirm that it has been informed about the accommodation rules, reservation rules and tariffs.
1.3. From the moment this contract is concluded, Mabeyn Bungalov will confirm the Customer’s request.
2. FORM OF ACCOMMODATION RESERVATION
2.1. It can be made by calling the reservation line at +90 (546) 744 87 52 or by filling out the reservation form on the https://www.mabeynbungalov.com/ website.
2.2. In case the Customer wants to terminate his/her request or make any changes, he/she can contact Mabeyn Bungalov’s Reservation Office at +90 (546) 744 87 52 or request a change by sending an e-mail to the e-mail address and specifying the date on which the change is desired.
2.3. If the customer wishes to cancel their request and receive the remaining amount after the deduction of the fee; they must cancel their reservation at least 15 days before the accommodation date. (Article 4.1)
2.4. The customer must submit their request to Mabeyn Bungalov to make a change in their reservation at least 15 days before Mabeyn Bungalov’s service date. In case of cancellation, 50% of the paid fee will be refunded to the customer. If there are less than 15 days left until the reservation date, no refund will be made. (Article 2.5)
2.5. Reservation changes (number of people, room type) will be made at quota prices appropriate to the conditions of the day the change is requested.
2.6. With this contract, the Customer accepts, declares and undertakes that in case of any change made/wants to make on the reservation during the period when the special discount is applied during the registration, the reservation will be made considering the prices applied during the confirmation date of the reservation change request in question.
2.7. The discount for children will be applied if they stay in the same room with their parents. The age of the child notified by the Customer during the reservation registration will be taken into account. If it is determined that the age of the child is different from the age stated on the ID requested by the authorized person during the reservation registration, the necessary changes will be made to the reservation and the Customer will cover the fee difference arising from this.
3. PAYMENT METHOD
3.1. The Customer will enter his/her own credit card information into the system during the payments made by credit card through the Online reservation system.
3.2. The Customer will be able to make the reservation payment by credit card as a single payment or according to the installment options applied by contracted banks. If the Customer chooses to pay in installments, the Customer is deemed to have accepted the maturity difference in the installment options in advance.
3.3. Mabeyn Bungalov accepts and declares that the credit card information and the system in which the information is provided are under the protection of a special security system that prevents the information from being viewed or copied in any way and under any circumstances. Mabeyn Bungalov will also not cover and will not be held responsible in any way for any damages that may occur due to third parties learning information, documents and secrets due to damaging programs and similar program systems originating from the Customer’s computer and the carelessness of the Customer.
3.4. The Customer will present the credit card used for payment while making the online reservation record to the Mabeyn Bungalov staff during the entrance to Mabeyn Bungalov. The Customer will be responsible for any damages/losses that may occur due to the Customer’s failure to fulfill these responsibilities.
3.5. The Customer will receive the invoice at Mabeyn Bungalov.
4. REFUND METHOD OF PAYMENT
4.1. In case the reservation cancellation request is canceled 15 days or more before the estimated check-in date, 50% of the total accommodation amount collected will be deducted and the entire remaining amount will be refunded to the bank account or card from which the guest made the payment. In case the reservation termination request is canceled 15 days or less before the estimated check-in date, it will not be possible to refund the accommodation fee collected from the guest; no show will be applied to the entire amount.
4.2. In payments made by credit card during reservation registration, the refund will be made by depositing it back to the credit card with which the payment was made or by EFT/Money Transfer to the bank account presented by the Customer.
4.3 Force majeure in reservation cancellation; In cases of natural disasters, terrorism, riots and documented death (1st and 2nd degree relatives), accidents and illnesses (full-fledged hospital report), Mabeyn Bungalov does not apply a No Show to the guest and the entire deposited fee is refunded.
4.4 In payments made by credit card, the remaining amount will be refunded after the transaction fee and commission are deducted.
5. ACCOMMODATION TYPE
5.1. The Customer’s age and identity will be checked during check-in. The Customer will cover the expenses incurred due to incorrect information provided by the Customer.
5.2. The Customer accepts that he/she will settle into the room as of 14:30 at the earliest on the day of arrival at Mabeyn Bungalow, and that he/she will check-out from the room at 12:00 at the latest, regardless of the time he/she checks out from Mabeyn Bungalow, and that he/she will pay the fee for the additional service to be provided after checking out of the room.
5.3. The full accommodation fee will be collected during the reservation registration.
5.4. Pets will not be accepted by Mabeyn Bungalow.
5.5. In the event that the Customer cancels the service for a reason other than Mabeyn Bungalow’s failure to fulfill its accommodation commitments after settling in Mabeyn Bungalow, the payment will not be refunded.
6. LIABILITY OF THE PARTIES
6.1. In case of poor quality service provided to the customer, the customer shall notify the Mabeyn Bungalow representative of his complaint in writing during his stay. Otherwise, the service provided by Mabeyn Bungalow shall be deemed to have been provided flawlessly and on time.
6.2. In case the customer violates any provision of the contract, the customer accepts and undertakes to cover any damages incurred by Mabeyn Bungalow as a result of the violation.
6.3. In case the guest behaves and acts in a manner that disrupts the order of Mabeyn Bungalow, Mabeyn Bungalow has the right to request the guest to leave Mabeyn Bungalow without a refund.
6.4. Based on the decision taken by the board of directors, visitors from outside of our guests staying at the facility will not be admitted to the facility. If the guest approves, daily usage conditions are applied for a fee for the visitors.
6.5. It is forbidden to enter the women’s section with cameras, camera phones, electronic devices capable of taking photos or videos. Legal action will be taken against guests who do not comply with these conditions.
7. OTHER PROVISIONS
7.1. Adverse weather conditions, strike-lockout, terrorism, military operation, flood, fire etc. In the event of such situations, Mabeyn Bungalov may not continue to provide service. In this case, guests who have made a reservation and made a payment will have their payments refunded.
7.2. Mabeyn Bungalov reserves the right to change the artist who will come to Mabeyn Bungalov due to other holiday programs such as Eid or New Year etc. for reasons not dependent on Mabeyn Bungalov (artist’s illness, force majeure etc.).
7.3. The competent court for the resolution of disputes arising under this agreement is the Rize Central courts.
